Release of Liability, Waiver of Claims & Assumption of Risk

PLEASE READ CAREFULLY BEFORE SUBMITTING

This Agreement is entered into between the Participant and:

Hosts / Organizers / Releasees:

  • I Love Stouffville
  • Imraz Ramani
  • Pause A While Equestrian Centre
  • Ramani Real Estate
  • All event volunteers, staff, guides, instructors, agents, contractors, sponsors, landowners, and representatives

(collectively referred to as the “Releasees”)


1. Description of Activity

The Participant understands that they are voluntarily participating in a Snowshoe Event, which may include walking, hiking, or trekking over snow-covered terrain using snowshoes on designated or undesignated trails or open areas.

The Participant understands that snowshoeing may occur on uneven, natural terrain and in winter weather conditions.


2. Acknowledgement of Risk

The Participant understands and acknowledges that snowshoeing involves inherent and serious risks, including but not limited to:

  • Slips, trips, and falls on snow, ice, or uneven ground
  • Hidden obstacles beneath snow (rocks, roots, holes, debris)
  • Sudden terrain changes or elevation changes
  • Ice-covered surfaces
  • Cold temperatures, frostbite, hypothermia, or exposure
  • Fatigue, dehydration, or overexertion
  • Equipment malfunction or improper use of snowshoes
  • Collisions with objects or other participants
  • Wildlife encounters
  • Negligence of staff, volunteers, or other participants
  • Serious injury, permanent disability, paralysis, or death

These risks cannot be eliminated, regardless of the care taken.


3. Voluntary Participation & Assumption of Risk

The Participant confirms that participation is voluntary and that they knowingly and freely assume all risks associated with the Snowshoe Event.


4. Equipment & Safety Requirements

The Participant acknowledges and agrees that:

  • Proper winter footwear (closed-toe boots with adequate traction) is mandatory
  • Appropriate winter clothing (layered clothing, gloves, hat, etc.) is required
  • Snowshoes must be properly fitted and secured before participation
  • The Participant is responsible for ensuring their clothing and footwear are suitable
  • Failure to comply with safety instructions may result in removal from the activity without refund

The Participant understands that proper equipment does not eliminate the risk of injury.


5. Release & Waiver of Liability

In consideration of being permitted to participate, the Participant:

Releases, waives, discharges, and holds harmless the Releasees from any and all liability, claims, demands, actions, or causes of action, including those arising from the negligence of the Releasees, related to participation in the Snowshoe Event, to the fullest extent permitted by the laws of Ontario, Canada.


6. Indemnification

The Participant agrees to indemnify and hold harmless the Releasees from any loss, liability, damage, cost, or expense (including legal fees) arising from participation.


7. Medical Responsibility

The Participant certifies that:

  • They are physically and mentally able to participate
  • They have no medical condition that would make participation unsafe
  • They understand the Releasees are not responsible for medical expenses

The Participant authorizes emergency medical treatment if deemed necessary and accepts responsibility for all related costs.


8. Rules & Conduct

The Participant agrees to:

  • Follow all instructions given by staff and guides
  • Stay within designated areas
  • Use snowshoe equipment properly
  • Avoid reckless or unsafe behavior
  • Inform staff immediately if feeling unwell

Failure to follow rules may result in removal without compensation.


9. Weather Conditions

The Participant understands that winter weather conditions may change rapidly and may include snow, wind, freezing rain, or extreme cold. Participation is at the Participant’s own risk.

Required Acknowledgements

I confirm that I have read and fully understand this Waiver.
I understand that I am waiving important legal rights.
I voluntarily assume all risks associated with participation.
I confirm that I will wear appropriate winter footwear and clothing.
I consent to emergency medical treatment if necessary.
